Contract Administration differs depending on the requirements of the contract. Stable Construction Consulting has experience of most standard form construction contracts, and can assist Contractors and Subcontracts in setting up and maintaining an appropriate Contract Administration procedure. In particular, we will:

 

  • Identify and ensure compliance with contract Notice requirements (e.g. Early Warning Notices, Condition Precedent claims Notices)
  • Manage procedures in connection with the control of changes/variations
  • Manage correct payment procedure mechanisms
  • Manage the production and issue of progress reports
  • Ensure the maintenance and issue of project documents and records
  • Liaise with the Employer regarding the timely issue of Certificates (e.g. Interim Payment Certificates;  Completion Certificates)

The maintenance of smooth and efficient contract administration is an important aspect of all construction contracts. Failure to issue appropriate notices may result in disputes and/or loss of entitlement to money. Similarly, poor change control can lead to under-recovery of both time and money and can, again lead to disputes.

 

If, despite good contract administration, disputes do occur, the Contractor will not be disadvantaged or hampered by a lack of records in support of his case. In the overwhelming majority of cases where entitlement to additional time or money exists, poor record keeping allied to poor contract administration can result in the eventual recovery being significantly less than may otherwise have been achieved.
